INTRODUCTORY ARTICLE – IDENTIFICATION OF THE SELLER
Isère Éditions SAS, a company with a share capital of €1,000, whose registered office is situated at Château de la Berrière, 44450 Divatte-sur-Loire, registered with the Nantes Trade and Companies Register under number 849 720 206, with VAT number FR48 849 720 206 (hereinafter “ISÈRE 1885” or “the Seller”), operates the website accessible at https://isere1885.com (hereinafter the “Website”).

ISÈRE 1885 sells, via the Site, a selection of products derived from the local region and expertise of Isère (hereinafter the “Products”), intended for end customers, natural persons of legal age acting as consumers (hereinafter the “Customer(s)”).
The Products are delivered to the following territories: mainland France, Corsica and Member States of the European Union (hereinafter the “Territory”). Any order destined for another territory may be refused or subject to special handling upon request to customer services.
ARTICLE 1 – SCOPE AND ACCEPTANCE
These general terms and conditions of sale (hereinafter the “GTC”) govern all sales of Products concluded remotely via the Website between ISÈRE 1885 and any Customer.
Any order placed on the Website (hereinafter the “Order”) implies the Customer’s full and unconditional acceptance of these T&Cs. To this end, during the Order process, the Customer must tick the box thereby acknowledging that they have read the T&Cs and accept them without reservation. This acceptance is in no way conditional upon a handwritten signature.
In accordance with Article 1127-1 of the Civil Code, these T&Cs may be retained by any person visiting the Website by means of electronic storage or by printing.
ISÈRE 1885 reserves the right to amend the T&Cs at any time. The T&Cs applicable to an Order are those in force and accepted by the Customer on the date of confirmation of that Order.
ARTICLE 2 – PRODUCT INFORMATION
The Products offered for sale are those listed on the Website on the day the Customer views it, subject to availability. Each Product is accompanied by a description setting out its essential characteristics, in accordance with Articles L. 111-1 and L. 111-2 of the French Consumer Code.
For food products, information regarding composition, allergens, nutritional values and the best-before date (BBD) or use-by date (UBD) is provided either on the product page on the Website or on the packaging delivered to the Customer.
Despite the care taken in presenting the Products, variations in colour, appearance or format may exist between the photographs on the Website and the Product actually delivered, due in particular to technical limitations in screen display and the handcrafted nature of certain Products. ISÈRE 1885 shall not be held liable for such non-substantial variations.
ISÈRE 1885 reserves the right to amend the list of Products offered for sale at any time, without prejudice to Orders already placed.
ARTICLE 3 – ORDERING PROCEDURES
3.1 Selection of Products
The Customer selects, from among the Products available for sale on the Website, those they wish to purchase, along with the quantity. They add these to their basket by clicking on the ‘Add to basket’ button. The basket does not in itself constitute an Order that is binding on ISÈRE 1885.
3.2 Customer Identification
The Customer may place an Order either by creating a customer account or in guest mode (where applicable). In all cases, they must provide their full name, delivery and billing details, and a valid email address.
The Customer’s login details and password are strictly personal and confidential. The Customer undertakes to keep them secure and to inform ISÈRE 1885 immediately in the event of loss, theft or fraudulent use.
3.3 Confirmation of the Order by the Customer
Before final confirmation, the Customer has the opportunity to check the details of their Order, its total price and the chosen delivery method, and to correct any errors. Final confirmation of the Order is made by clicking on the “Proceed to payment” button or any equivalent button. This confirmation constitutes an obligation to pay.
3.4 Order Confirmation by ISÈRE 1885
Once the Order has been confirmed by the Customer, ISÈRE 1885 will acknowledge receipt by email. Upon confirmation of payment, ISÈRE 1885 will send the Customer an Order Confirmation (hereinafter the “Order Confirmation”) by email, including the Order number, the details and price of the Products, the delivery charges, and these T&Cs.
The Order Confirmation constitutes ISÈRE 1885’s acceptance of the Order and the conclusion of a binding sales contract between the parties.
In accordance with Article L. 213-1 of the French Consumer Code, where an Order is for an amount equal to or greater than one hundred and twenty (120) euros, ISÈRE 1885 shall retain the details relating to that Order for ten (10) years from the date of delivery, and shall make them available to the Customer upon request.
3.5 Refusal and cancellation of Orders
ISÈRE 1885 reserves the right to refuse or cancel any Order that is abnormal, suspected of fraud, involves a payment default, or is placed by a Customer with whom there is an outstanding dispute relating to a previous Order. ISÈRE 1885 also reserves the right to limit the number of Products ordered in a single transaction.
ARTICLE 4 – PRICES
The prices of the Products displayed on the Website are quoted in euros, inclusive of all taxes (TTC), excluding delivery charges. Delivery charges are shown to the Customer before the Order is finally confirmed and are added to the price of the Products.
The applicable prices are those displayed on the Website at the time the Order is confirmed. ISÈRE 1885 reserves the right to amend its prices at any time, on the understanding that Products will be invoiced on the basis of the prices in force at the time of the Order, subject to availability.
ISÈRE 1885 carries out regular checks to ensure that the prices charged are correct. However, in the event of an obvious pricing error, ISÈRE 1885 reserves the right to cancel the affected Order, after informing the Customer. In such cases, the Customer will be fully refunded for any sums paid.
ARTICLE 5 – PAYMENT TERMS
5.1 Accepted payment methods
Payment for Orders is made exclusively online, using the following payment methods: credit card (CB, Visa, Mastercard, American Express, as applicable), as well as any other payment method offered on the Website at the time of the Order (including PayPal, Apple Pay and Google Pay).
The Customer warrants to ISÈRE 1885 that they are the holder of the credit card used for payment and that the surname and first name appearing on that card are indeed their own.
Payment is due immediately upon placing the Order. The Customer’s credit card will be debited upon dispatch of the Order, or in accordance with the terms specific to the chosen payment method.
5.2 Payment security
Online payments are secured by ISÈRE 1885’s payment service provider [SPECIFY THE PROVIDER – e.g. Stripe, Stancer, Payplug…]. The Customer’s bank details are never stored by ISÈRE 1885.
In the event that, for any reason whatsoever (dispute, refusal by the issuing bank, etc.), it proves impossible to debit the amounts due, the Order will be immediately cancelled.
5.3 Payment in installments (if applicable)
Where applicable, ISÈRE 1885 offers interest-free installment payments through its partner [TO BE COMPLETED – e.g., Alma], subject to the terms and amount limits indicated on the Site at the time of the Order. Installment payments are subject to the general terms and conditions of use of the relevant service provider, which the Customer expressly accepts by choosing this payment method.
ARTICLE 6 – PRODUCT AVAILABILITY
Product offers are valid as long as they are visible on the Website and while supplies last. In the event of total or partial unavailability of a Product after the Order has been placed, ISÈRE 1885 will notify the Customer by email as soon as possible.
In the event of total unavailability, the Order will be canceled and the Customer will be fully refunded within a maximum of fourteen (14) days.
In the event of partial unavailability, the Customer will be notified and may choose between delivery of only the available Products (with a refund for the unavailable Products) or full cancellation of the Order with a full refund.
ARTICLE 7 – DELIVERY
7.1 Delivery Area and Terms
Products are delivered to the delivery address provided by the Customer at the time of the Order, within the Territory defined in the introductory article. No deliveries may be made outside the Territory.
Delivery is carried out by ISÈRE 1885’s partner carriers [SPECIFY: Colissimo, Chronopost, Mondial Relay, etc.], depending on the delivery method selected by the Customer when placing the Order. Delivery charges vary depending on the selected method, weight, and destination, and are communicated to the Customer prior to Order confirmation.
7.2 Delivery Times
The ordered Products are shipped within an estimated timeframe of [X] business days from the Order Confirmation. The total delivery time includes this preparation period and the carrier’s transit time.
In accordance with Article L. 216-1 of the French Consumer Code, ISÈRE 1885 undertakes to deliver the Products within a maximum of thirty (30) days from the Order Confirmation, unless a different timeframe is expressly agreed upon by the Customer at the time of the Order.
In the event of a delivery delay attributable to ISÈRE 1885, the Customer may, after having given ISÈRE 1885 formal notice to deliver within a reasonable additional period and having received no response, terminate the contract in accordance with Article L. 216-2 of the French Consumer Code. The amounts paid will then be refunded within 14 days.
7.3 Acceptance and Defects
Risk of loss or damage to the Products passes to the Customer at the time the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of the Products.
The Customer is advised to verify the Products’ conformity upon arrival and, in the event of any discrepancies (open package, damaged or missing Product, etc.), to note specific, handwritten, and dated reservations on the delivery slip, and to notify ISÈRE 1885 as soon as possible at the email address [TO BE COMPLETED].
7.4 Specifics Regarding Food Products
For food Products subject to special storage conditions (particularly fresh Products or those requiring controlled temperature), the Customer agrees to be present or to arrange for the package to be received at the time of delivery. ISÈRE 1885 shall not be held liable for any deterioration of a Product resulting from failure to receive the package or failure to comply with storage conditions after delivery.
ARTICLE 8 – RIGHT OF WITHDRAWAL
In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the consumer Customer has a period of fourteen (14) days from receipt of the Products to exercise their right of withdrawal, without having to justify their decision or bear any costs other than those provided for in Articles L. 221-23 through L. 221-25 of the French Consumer Code.
When the Order consists of multiple Products delivered separately, the period begins upon receipt of the last Product.
8.1 Exclusions from the Right of Withdrawal
In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal may not be exercised for contracts relating in particular to:
- the supply of goods liable to deteriorate or expire rapidly (including fresh produce and certain food products);
- the supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection;
- the supply of goods made to the Customer’s specifications or clearly personalized;
- the supply of alcoholic beverages whose delivery is deferred beyond thirty (30) days and whose value agreed upon at the time of contract conclusion depends on market fluctuations beyond the Seller’s control;
- the supply of audio or video recordings or computer software when they have been unsealed after delivery.
8.2 How to Exercise the Right of Withdrawal
To exercise their right of withdrawal, the Customer must notify ISÈRE 1885 of their decision by means of an unambiguous statement, for example:

- or by using the standard withdrawal form attached to these Terms and Conditions.
To ensure that the withdrawal period is met, it is sufficient for the notification to be sent before the expiration of the fourteen (14) day period.
8.3 Effects of Withdrawal
In the event of withdrawal, the Customer must return the Products to ISÈRE 1885 without undue delay and no later than fourteen (14) days after notifying ISÈRE 1885 of their decision. The Products must be returned in their original condition, complete, unused, undamaged, and accompanied by all accessories and the invoice.
The direct costs of returning the Products are the Customer’s responsibility, unless otherwise specified on the Website.
ISÈRE 1885 will refund the Customer the full amount paid, including the initial shipping costs (excluding any additional costs associated with choosing a more expensive shipping method than the standard option offered), no later than fourteen (14) days from the date ISÈRE 1885 is notified of the decision to cancel. However, the refund may be deferred until the Products are recovered or until the Customer has provided proof of shipment of such Products, whichever occurs first.
The refund will be made via the same payment method used by the Customer for the Order, unless the Customer expressly agrees to another method. This refund will not incur any costs for the Customer.
The Customer shall only be liable for any depreciation of the Products resulting from handling other than that necessary to determine their nature, characteristics, and proper functioning.
ARTICLE 9 – STATUTORY WARRANTIES
Notwithstanding any commercial warranties that may be provided, ISÈRE 1885 remains bound by the statutory warranty of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
9.1 Statutory Warranty of Conformity
ISÈRE 1885 delivers Products that conform to the contract and is liable for any lack of conformity existing at the time of delivery, under the conditions set forth in Articles L. 217-3 et seq. of the French Consumer Code.
The Customer has a period of two (2) years from the delivery of the Product to take action. The Customer may choose between repair or replacement of the Product, subject to the cost conditions set forth in Article L. 217-12 of the Consumer Code. The Customer is exempt from providing proof of the existence of the lack of conformity for twenty-four (24) months following delivery of the Product, except for used goods (six months).
Where repair or replacement is impossible, or cannot be carried out within one month of the Customer’s complaint, or would cause significant inconvenience to the Customer, the Customer may obtain rescission of the sale or a price reduction in accordance with Articles L. 217-14 and L. 217-15 of the French Consumer Code.
9.2 Warranty Against Hidden Defects
In accordance with Articles 1641 et seq. of the Civil Code, ISÈRE 1885 is liable for hidden defects in the item sold that render it unfit for its intended use, or that so diminish its use that the buyer would not have purchased it, or would have paid a lower price for it, had they been aware of such defects.
Any claim arising from such defects must be brought by the purchaser within two (2) years of the discovery of the defect (Article 1648 of the Civil Code). The Customer may choose between rescission of the sale or a reduction in price in accordance with Article 1644 of the Civil Code.
9.3 Exercising Warranties
To exercise either of the statutory warranties, the Customer must submit a request to ISÈRE 1885’s customer service department via email at contact@isere1885.com or by mail to the registered office address, attaching any relevant supporting documentation (invoice, photographs, description of the defect, etc.).
9.4 Exclusions
The following are specifically excluded from the scope of the warranties: defects resulting from abnormal use or use not in accordance with the Product’s intended purpose; lack of maintenance; modifications or repairs performed by the Customer or an unauthorized third party; normal wear and tear; or any damage caused by a force majeure event.

ARTICLE 11 – RETENTION OF TITLE
ISÈRE 1885 retains full and complete ownership of the Products sold until full payment has been received, including the principal amount, fees, taxes, and mandatory charges. However, the transfer of risk occurs at the time the Customer or a third party designated by the Customer takes physical possession of the Product.
ARTICLE 12 – INTELLECTUAL PROPERTY
All elements appearing on the Site (text, photographs, illustrations, logos, trademarks, layouts, graphic design, videos, sounds, etc.) are the exclusive property of ISÈRE 1885 or its partners and are protected by intellectual property law, in particular by copyright and trademark law.
Any reproduction, representation, modification, publication, transmission, or distortion, in whole or in part, of the Site or its content, by any means and on any medium whatsoever, is strictly prohibited without the prior written authorization of ISÈRE 1885. Any unauthorized use of the Site or any of the elements it contains shall be considered an infringement and prosecuted in accordance with the provisions of Articles L. 335-1 et seq. of the Intellectual Property Code.
ARTICLE 13 – PERSONAL DATA
ISÈRE 1885 collects and processes the Customer’s personal data for the purposes of managing Orders, the customer account, the business relationship, and, where applicable, marketing activities, in accordance with Regulation (EU) 2016/679 of April 27, 2016 (“GDPR”) and Law No. 78-17 of January 6, 1978, as amended (“Data Protection Act”).
The Customer has the right to access, rectify, erase, restrict, and object to the processing of their data, as well as the right to data portability and the right to provide instructions regarding the fate of their data after their death. The Customer also has the right to file a complaint with the French Data Protection Authority (CNIL – www.cnil.fr).
ARTICLE 14 – FORCE MAJEURE
ISÈRE 1885’s performance of all or part of its obligations shall be suspended in the event of a force majeure event as defined in Article 1218 of the Civil Code, which would hinder or delay such performance. ISÈRE 1885 shall notify the Customer of such an event as soon as possible following its occurrence.
ARTICLE 15 – LIABILITY
ISÈRE 1885 shall not be held liable for any failure to perform or improper performance of the contract attributable either to the Customer, or to an unforeseeable and insurmountable act by a third party unrelated to the provision of the services specified in the contract, or to a force majeure event.
ISÈRE 1885 shall not be held liable for any indirect damages that may result from the use of the Site, including loss of business, loss of data, damage to reputation, or any other intangible loss.
ISÈRE 1885 shall not be held liable for damages resulting from the use of the Site on defective or unsuitable equipment, nor for viruses, bugs, or service interruptions beyond its control.
ARTICLE 16 – EVIDENCE
The electronic records stored in the computer systems of ISÈRE 1885 and its partners (including payment and shipping providers), under reasonable security conditions, are considered proof of communications, Orders, and payments made between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as evidence.
ARTICLE 17 – DISPUTE RESOLUTION – MEDIATION – GOVERNING LAW
These Terms and Conditions are governed by French law.
In the event of a dispute, the Customer is encouraged, as a first step, to contact ISÈRE 1885’s customer service department to seek an amicable resolution.
In accordance with Articles L. 611-1 et seq. of the French Consumer Code, the Customer has the right to seek the assistance of a consumer mediator free of charge to resolve an amicable settlement of a dispute between the Customer and ISÈRE 1885. The competent mediator is:

In accordance with Article 14 of Regulation (EU) No. 524/2013 of May 21, 2013, the European Commission also provides consumers with a European Online Dispute Resolution (ODR) platform accessible at: https://ec.europa.eu/consumers/odr.
In the absence of an amicable settlement, any dispute relating to the formation, performance, or interpretation of these Terms and Conditions shall fall within the jurisdiction of the French courts. In accordance with Article R. 631-3 of the French Consumer Code, the consumer may, at their discretion, bring a claim before either one of the courts with territorial jurisdiction under the Code of Civil Procedure or the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
ARTICLE 18 – MISCELLANEOUS PROVISIONS
If any provision of these Terms and Conditions is held to be invalid or unenforceable, in whole or in part, by a final court decision, the remaining provisions shall remain fully enforceable.
The fact that ISÈRE 1885 does not invoke any provision of these Terms and Conditions at a given time shall not be construed as a waiver of the right to invoke it at a later time.
These Terms and Conditions are written in French. In the event of a translation, only the French version shall be binding between the parties.
